Trick Bits is powered by Shopify, which enables us to provide the Services. This Privacy Policy describes how we collect, use and disclose your personal information when you visit, use, make a purchase or other transaction through the Services, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing and disclosure of your personal information.

Please read this Privacy Policy carefully. By using or accessing the Services, you acknowledge that you have read and understand the collection, use and disclosure of your information described here.

Personal Information We Collect or Process

When we use the term personal information, we mean information that identifies or can reasonably be linked to you or another person. It does not include anonymised or de-identified information that cannot reasonably identify or be linked to a person. Depending on how you interact with the Services, where you live, and as permitted or required by law, we may collect or process:

  • Contact details, including your name, address, billing address, shipping address, phone number and email address.
  • Financial information, including payment card and financial-account information, transaction details, payment confirmation and other payment details.
  • Account information, including your username, password, security questions, preferences and settings.
  • Transaction information, including items you view, place in your cart or wishlist, purchase, return, exchange or cancel, and your past transactions.
  • Communications, including information you include when contacting us for support.
  • Device information, including device, browser and network information, IP address and other identifiers.
  • Usage information, including how and when you interact with or navigate the Services.

Personal Information Sources

We may collect personal information directly from you; automatically through the Services, your device, cookies and similar technologies; from service providers that enable technology or process information on our behalf; and from partners or other third parties.

How We Use Your Personal Information

  • Provide, tailor and improve the Services. This includes processing payments, fulfilling orders, remembering preferences, sending account and transaction notifications, managing accounts, arranging shipping, facilitating returns and exchanges, enabling reviews, and improving your shopping experience.
  • Marketing and advertising. We may send marketing and promotional communications and show advertising for products or services on the Services and other websites, including based on your prior purchases, cart activity and other activity on the Services.
  • Security and fraud prevention. We use information to authenticate accounts, provide a secure payment and shopping experience, detect and investigate fraudulent, illegal, unsafe or malicious activity, and protect our Services.
  • Communicating with you. We use information to provide customer support and maintain our business relationship with you.
  • Legal reasons. We may use information to comply with law or valid legal process, investigate or participate in legal proceedings, and enforce or investigate potential violations of our terms or policies.

How We Disclose Personal Information

We may disclose personal information to Shopify, vendors and other service providers that perform services on our behalf, such as IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and shipping. We may also disclose it to business and marketing partners to provide marketing services and advertising; where you direct, request or consent to a disclosure; within our corporate group; or in connection with a business transaction, legal obligation, or protection of our rights, the Services or others.

Relationship with Shopify

The Services are hosted by Shopify. Shopify collects and processes personal information about your access to and use of the Services to provide and improve them. Information you submit may be transmitted to Shopify and third parties located in countries other than where you reside. We may use Shopify enhanced features that use information from interactions with our store, other merchants and Shopify. In those circumstances, Shopify is responsible for that processing and for responding to applicable rights requests. See the Shopify Consumer Privacy Policy and the Shopify Privacy Portal.

Jarvis Business OS and eBay Seller Data

Where authorised by the relevant seller account, Trick Bits may use Jarvis Business OS to connect to business systems such as eBay. This may process seller-account and business data available through the authorised connection, including account or shop identifiers, listings, inventory, orders, fulfilment, transactions, fees, payments and messages.

We use this information only to operate, analyse, support and improve Trick Bits business operations. We do not sell eBay seller data. Access is controlled through the relevant provider authorisation and can be revoked through eBay or the connection-management interface. We retain connected-business data only for the purpose for which it was collected and for any applicable legal or record-keeping requirement. Where we receive a valid marketplace account-deletion notification, we take the applicable action required by eBay and law.

Third-Party Websites and Links

The Services may link to third-party websites or platforms. If you follow those links, review their privacy and security policies. We are not responsible for the privacy, security, accuracy, completeness or reliability of third-party sites or publicly or semi-publicly shared information. Including a link does not imply endorsement unless we say otherwise.

Children's Data

The Services are not intended for children. We do not knowingly collect personal information about children under the age of majority in their jurisdiction. If you are a parent or guardian and believe a child has provided personal information, contact us using the details below to request deletion. As of the effective date of this policy, we do not have actual knowledge that we share or sell personal information of individuals under 16 years of age, as those terms are defined in applicable law.

Security and Retention of Your Information

No security measure is perfect or impenetrable, and we cannot guarantee perfect security. Information sent to us may not be secure in transit; do not use insecure channels to send sensitive or confidential information. We retain personal information for as long as necessary to maintain an account, provide the Services, comply with legal obligations, resolve disputes or enforce applicable agreements and policies.

Your Rights and Choices

Depending on where you live, you may have rights to request access to, deletion, correction or portability of your personal information. You may also have a right to opt out of the sale or sharing of personal information, or processing for targeted advertising, where applicable. Promotional emails include an unsubscribe option; even if you opt out, we may still send non-promotional messages about your account or orders.

If you reside in the UK or European Economic Area, subject to local-law limitations and exceptions, you may also have rights to object to or restrict processing and to withdraw consent where processing is based on consent. You may exercise applicable rights through the Services where indicated or by contacting us using the details below. We may need to verify your identity before responding, as permitted or required by law. We will not discriminate against you for exercising applicable rights.

Complaints

If you have a complaint about how we process personal information, contact us using the details below. Depending on where you live, you may also have the right to appeal our decision or lodge a complaint with your local data-protection authority.

International Transfers

We may transfer, store and process your personal information outside the country where you live. If we transfer information out of the European Economic Area or the United Kingdom, we will rely on recognised transfer mechanisms, such as the European Commission's Standard Contractual Clauses or equivalent UK arrangements, unless the destination country has been recognised as providing an adequate level of protection.

Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to our practices or for operational, legal or regulatory reasons. We will post the revised policy on this website, update the Last updated date and provide notice where required by law.
